Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern access to and use of the services offered by Materiatek ASBL ("Materiatek", "we", "our" or "us"), a non-profit organization registered in Belgium, with registered office at Rue Van Malder 24,1080 Molenbeek-Saint-Jean, enterprise number 1020.719.221.

By subscribing to our services, using our premises, or attending our events, you agree to comply with these Terms. If you do not agree, please refrain from using our services.

This agreement constitutes a service contract (overeenkomst van dienstverlening) under Belgian law. It does not grant the member any real property rights or tenancy interests in Materiatek's premises.

2. Definitions

  • Member: A person or entity with an active subscription to Materiatek’s services.
  • Resident: A person who holds a coworking desk at Materiatek.
  • Visitor: A person who visits Materiatek as a guest or participant in an event.
  • Material Library: The physical and digital collection of samples and related materials accessible to members.
  • Events: Workshops, product showcases, and conferences organized or hosted by Materiatek.

3. Scope of Services

Materiatek offers:

  • Paid subscription-based access to the materials library, including assistance from a materials librarian and the ability to borrow samples under defined conditions.
  • Organization of workshops and conferences related to design, architecture, and materials.
  • Coworking spaces dedicated to professionals in spatial design.
  • Event space rental and curated events for members, residents, and invited guests.

Materiatek offers the following membership tiers:

  • Materials library member: Access to the materials library during standard operating hours.
  • Cowork member: Includes basic access to the premises plus participation in various event types.
  • Events member: Includes punctual access and priority to event bookings.

4. Membership and Registration

To access Materiatek’s services, users must register and subscribe via our official website or directly on-site. We offer multiple subscription tiers with varying access rights. Details are available on our website or upon request.

All information provided during registration must be accurate and kept up to date.

Subscriptions to the materials library require a minimum commitment of six months, with certain plans requiring a full year. At the end of the initial term, memberships may automatically renew on a monthly or annual basis, depending on the plan selected. Members will be notified in advance of any changes to terms or pricing.

5. Payment and Cancellation

Subscriptions and services are billed monthly or annually, depending on the plan. Payments must be made in advance by bank transfer, credit/debit card, or other accepted methods.

Members may cancel their subscription by providing a written notice of one month. Refunds for unused services are not provided, except as required by Belgian consumer protection laws. An administrative fee of €50 applies to early terminations.

Event and space rental cancellations must be made at least 14 days in advance for a full refund. Later cancellations may incur partial or full charges.

6. Use of Facilities and Materials

Members and residents agree to:

  • Use all materials, equipment, and spaces responsibly.
  • Return borrowed samples in the same condition as received, by the agreed deadline.
  • Refrain from damaging, misusing, or removing any materials not explicitly loaned.
  • Maintain cleanliness and order in shared spaces.

Borrowed materials must be used solely for professional, non-commercial research or project development unless otherwise agreed in writing. Display or promotional use must credit the origin of the sample and, if requested, Materiatek.

Materiatek reserves the right to charge for damage or loss.

7. Guest Access

Guests are welcome in Materiatek's spaces only when accompanied by a registered member or resident. Members are responsible for the behavior of their guests and must ensure they adhere to these Terms. Guests must sign in and may be restricted to certain areas unless otherwise approved.

8. Conduct and Community Standards

All users must:

  • Respect fellow members, staff, and visitors.
  • Avoid disruptive behavior, excessive noise, or unsafe practices.
  • Abide by alcohol and event conduct policies outlined in our internal guidelines.
  • Comply with fire, safety, and public health regulations.
  • Follow any published house rules posted in the facility or distributed via email.

Failure to comply may result in suspension or termination of access without refund.

9. Privacy and Data Protection

We collect and process personal data in accordance with the EU General Data Protection Regulation (GDPR).

Data collected may include name, contact details, payment information, professional affiliations, and usage behavior. This data is used to manage memberships, provide services, and communicate updates.

Materiatek collects personal data such as names, contact information, and usage history to manage memberships and improve services. Data is retained for the duration of the membership and up to five years thereafter, in compliance with legal obligations. Members have the right to access, rectify, or delete their personal data by contacting [Data Protection Officer's contact information].

10. Intellectual Property

All content created or published by Materiatek (including digital content, photos, and event materials) is protected by copyright and remains our property unless otherwise stated.

Users retain rights to any proprietary content they share in workshops or displays, but by participating, you grant us a non-exclusive right to reference such content for documentation or promotion unless you opt out in writing.

Use of borrowed samples for commercial or public presentation requires prior written permission and proper crediting of the source and Materiatek.

11. Liability and Insurance

Materiatek is not liable for:

  • Personal belongings lost, stolen, or damaged on premises.
  • Injuries resulting from misuse of space or equipment.
  • Indirect or consequential damages from service interruptions or scheduling changes.

Members and residents are advised to secure their own insurance coverage for personal property and professional activities. Materiatek's insurance policies do not extend to members' belongings or liabilities arising from their use of the facilities.

We strive to maintain a safe and functional environment but provide services "as is."

12. Termination and Suspension of Services

We reserve the right to suspend or terminate access to services or spaces in cases of:

  • Breach of these Terms
  • Misconduct, harassment, or damage
  • Non-payment of fees

Materiatek will provide notice and an opportunity to address any issues before taking action, except in cases of serious breach or safety concerns. Upon termination, all outstanding balances must be settled and borrowed materials returned.

Users may also terminate their membership at the end of the agreed period by giving at least one month’s written notice.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed under Belgian law.

In the event of a dispute, parties agree to attempt resolution through mediation before initiating legal proceedings. If mediation fails, disputes will be subject to the exclusive jurisdiction of the courts of Brussels, unless otherwise required by law.
